1. Acceptance of these terms

These terms govern your use of https://weatherfordtxfrenchdrain.com and any related pages or forms operated by J&N Peak LLC (the "Company", "we" or "us") under the name Weatherford TX French Drain. By using the site or submitting a request through it, you agree to these terms. If you do not agree, do not use the site.

2. Nature of the service: lead generation and referral only

This site is an independent lead generation and referral service. It does not perform drainage or excavation work. Requests are shared with one or more independent local contractors, who are solely responsible for their own licensing, insurance, workmanship and pricing.

Stated plainly: this is an independent lead generation and referral service. We do not perform drainage work, excavation, trenching, grading, foundation work or any other construction or repair service. We do not supervise, direct, employ or control any contractor.

All work is performed by independent contractors. Each contractor is solely and exclusively responsible for its own licensing, registration, permitting, insurance, bonding, workforce, safety practices, workmanship, materials, warranties, scheduling and pricing. Any contract for work is formed directly between you and that contractor, and we are not a party to it.

We make no guarantee of work, of pricing, of availability, of response time, of contractor selection or of outcome. We do not guarantee that any contractor will contact you, quote your project, accept your project or complete it, nor that any particular result will be achieved. Any disputes arising from work performed are between you and the contractor.

Information on this site about soils, geology, drainage methods, equipment and cost factors is general educational content about conditions in Parker County and surrounding areas. It is not engineering advice, not a site specific recommendation and not a substitute for an on site evaluation by a qualified professional.

3. Submissions and contact consent

When you submit a form or call a number listed on the site, you consent to being contacted by us and by one or more independent contractors at the phone number, email address or mailing address you provide, including by automated means or prerecorded message where permitted by law, and you understand that message and data rates may apply. You may withdraw consent at any time by telling the contacting party to stop or by emailing JayPeak1425@gmail.com. See the Privacy Policy for how information is handled.

You agree that the information you provide is accurate and that you are the property owner or are authorized to request work on the property described.

4. Acceptable use

You agree not to:

• Submit false, misleading, fraudulent or unauthorized information.
• Submit another person's information without their permission.
• Use the site for any unlawful purpose or in violation of any applicable law.
• Scrape, harvest, crawl or otherwise collect data from the site by automated means without written permission.
• Attempt to gain unauthorized access to the site, its systems, its networks or any account.
• Interfere with or disrupt the site, introduce malicious code, or place unreasonable load on the infrastructure.
• Copy, reproduce, republish or redistribute site content for commercial purposes without written permission.

We may suspend or refuse service, remove content and block access at our discretion if we believe these terms have been violated.

5. Intellectual property

The site, its text, layout, design, graphics and compilation are owned by the Company or its licensors and are protected by applicable intellectual property law. You may view and print pages for your own personal, non commercial use.

6. No warranty

The site and all content and referral services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied or statutory. To the fullest extent permitted by law, the Company disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title and non infringement.

We do not warrant that the site will be uninterrupted, secure or error free, that content is accurate, complete or current, or that any contractor referred through the site is licensed, insured, competent, available or suitable for your project. Verifying a contractor's credentials, insurance and references is your responsibility.

7. Limitation of liability

To the fullest extent permitted by law, the Company and its members, managers, officers, employees, agents and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, property damage, personal injury, business interruption or loss of goodwill, arising out of or relating to your use of the site or to any work performed or not performed by any contractor, whether based in contract, tort, negligence, strict liability or any other theory, even if advised of the possibility of such damages.

To the fullest extent permitted by law, the total aggregate liability of the Company for all claims relating to the site or the referral service is limited to one hundred United States dollars. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

8. Indemnification

You agree to indemnify, defend and hold harmless the Company and its members, managers, officers, employees and agents from and against any claims, demands, damages, losses, liabilities, costs and expenses, including reasonable attorney fees, arising out of your use of the site, your violation of these terms, or any dispute between you and a contractor.

9. Third party links and services

The site may link to or reference third party websites, contractors, tools and services. Those are provided for convenience only. We do not control them, do not endorse them by linking to them, and are not responsible for their content, practices, availability, privacy policies or the products and services they provide. Your dealings with any third party are solely between you and that third party.

11. Governing law

These terms and any dispute arising out of or relating to them or to the site are governed by the laws of the State of Texas, without regard to its conflict of law rules. Subject to section 10, the state and federal courts located in the State of Texas shall have jurisdiction over any dispute.

12. Changes to these terms

We may update these terms at any time. The revised version takes effect when posted, and the "Last updated" date above will change. Continued use of the site after an update constitutes acceptance of the revised terms.

13. Severability and entire agreement

If any provision of these terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will stay in full force. These terms, together with the Privacy Policy, are the entire agreement between you and the Company regarding the site.
